The applicant filed a human rights application alleging discrimination on the basis of disability, marital status, and reprisal, over a year after her dismissal.
The respondents sought to dismiss the application for delay and on the basis that the substance of the application was already dealt with by the Employment Insurance Board of Referees.
The Tribunal found the delay was incurred in good faith due to the applicant's reliance on her paralegal's erroneous advice, with no substantial prejudice to the respondents.
Under section 45.1, the Tribunal dismissed the allegations relating to the termination of employment, as the Board of Referees had already determined the applicant was dismissed solely for misconduct.
However, the Tribunal allowed the allegations regarding failure to accommodate and a poisoned work environment to proceed, as they were not dealt with by the Board of Referees.
