The applicant, a unit owner and former board member, applied to the Condominium Authority Tribunal for access to various condominium records, including in-camera board minutes, management reports, and notes from informal board meetings.
The Tribunal denied access to the in-camera minutes, finding that redactions would not protect privacy in a small building and that statutory exemptions applied.
The Tribunal also denied access to management reports, except for portions formally adopted into the minutes.
However, the Tribunal ordered the respondent to produce notes from two informal board sessions because the board had previously resolved to include them in the official minute book.
Requests for penalties and costs from both parties were dismissed.
