The applicant sought statutory accident benefits following a motor vehicle accident.
The respondent denied the claims on the basis that the applicant's injuries fell within the Minor Injury Guideline (MIG).
The Tribunal found that the applicant failed to prove his physical or psychological injuries warranted removal from the MIG.
However, the Tribunal determined that the respondent's denial letters were boilerplate and failed to comply with the notice requirements under s. 38(8) of the Schedule.
Consequently, pursuant to s. 38(11), the respondent was ordered to pay the incurred expenses for the disputed treatment plans, plus interest.
The applicant's request for a special award was dismissed.
