The appellant appealed the Ministry of Health's decision to deny access to records relating to the potential sale of Connaught Laboratories.
The Ministry claimed exemptions under sections 12(1), 15, 17, and 18 of the Freedom of Information and Protection of Privacy Act.
The Assistant Commissioner found that certain records were exempt under section 12(1) as they would reveal the substance of Cabinet deliberations.
Portions of other records were found exempt under section 17(1) as they contained commercial information supplied in confidence by a third party, the disclosure of which could reasonably be expected to prejudice its competitive position.
The remaining exemptions claimed by the Ministry were not upheld, and the public interest override in section 23 was found not to apply.
The Ministry was ordered to disclose the non-exempt records.
