The Ontario Land Tribunal held a third Case Management Conference regarding appeals by the applicant against the municipality's failure to make a decision on applications for a zoning by-law amendment, draft plan of subdivision, and site plan control for a residential subdivision.

The Tribunal approved the draft Procedural Order and Issues List submitted by the parties and scheduled a five-day merit hearing.

The parties resolved the draft Procedural Order and Issues List on consent prior to the scheduled second Case Management Conference.

The Ontario Land Tribunal issued the Procedural Order to govern the proceedings leading up to a 10-day video hearing scheduled to commence on March 11, 2024, regarding an appeal of a zoning by-law amendment application for a 35-storey mixed-use building.

The National Capital Commission and Greenspace Alliance appealed the City of Ottawa's 2003 comprehensive Official Plan.

On January 19, 2023, the National Capital Commission withdrew its appeal, which was the sole remaining appeal.

Pursuant to subsection 17(30) of the Planning Act, the Ontario Land Tribunal dismissed the appeals and closed its files, bringing the Official Plan into effect.

The Ontario Land Tribunal issued a procedural order setting the hearing schedule and pre-hearing requirements for an expropriation compensation claim brought by Pine View Motors Limited and Pine View Auto Sales Inc. against the Regional Municipality of York.

The order schedules a nine-day video hearing to commence on May 15, 2023, and sets deadlines for motions arising from discovery, mediation, and the exchange of expert reports and witness statements.

The applicant appealed the City of Toronto's failure to make a decision on a draft plan of subdivision for a mixed-use development on the waterfront.

Following mediation and revisions to the draft plan, the parties reached a settlement.

Based on the uncontested evidence of the applicant's expert, the Tribunal allowed the appeal in part, approved the revised conditions of draft plan approval, and referred final approval of Phase 1 to the City.

The Ontario Land Tribunal issued an amending order to correct a technical error in its previous decision dated November 16, 2021, regarding the St. Lawrence Neighbourhood Heritage Conservation District Plan.

Pursuant to Rule 24.4 of the Tribunal's Rules of Practice and Procedure, the Tribunal replaced 'Appendix C – Schedule of Properties' with a revised version dated December 13, 2021.

In all other respects, the original order remains unchanged.

The applicant appealed the City of Toronto's failure to make a decision on a draft plan of subdivision for a mixed-use waterfront development.

Following mediation and revisions to the draft plan, the parties consented to the approval of the revised plan.

The Tribunal allowed the appeal in part, approving the revised draft plan of subdivision and associated conditions, save for certain deferred conditions relating to municipal infrastructure, finding the plan consistent with provincial policies and the City's Official Plan.
