The Ontario Review Board held a mandatory hearing to review the disposition of the accused, who was previously found unfit to stand trial for assault causing bodily harm.
The accused, who suffers from a major neurocognitive disorder due to traumatic brain injuries, resides in a long-term care facility with 1:1 supervision.
The Board found that the accused remains permanently unfit to stand trial due to his cognitive deficits.
Furthermore, given his physical decline and the ongoing supervision at his residence, the Board concluded he no longer poses a significant threat to public safety.
The Board recommended that the court hold an inquiry to determine if a stay of proceedings should be ordered.
