The Registrar issued a Notice of Proposal to suspend the Licensee's liquor licence, alleging that the Licensee permitted drunkenness and served an intoxicated patron on two separate dates.

The Board found that on the first date, the patron in question likely had a mental disability rather than being intoxicated, and the Licensee did not know or ought to have known of any drunkenness.

On the second date, an intoxicated female patron was denied service and entry by the Licensee, meaning the Licensee did not permit her drunkenness.

All allegations were dismissed.

The Registrar of the Alcohol and Gaming Commission of Ontario sought to revoke the liquor licence of Tropix Restaurant & Lounge following an incident involving a fight and a firearm on the premises.

The Licensee admitted to keeping off-licence liquor for sale.

The Board found that the Licensee's security staff acted reasonably and swiftly to quell the fight and that the Licensee had reasonable measures in place to deter disorderly conduct.

The allegations of permitting disorderly conduct and failing to deter disorderly conduct outside the premises were dismissed.

A finding was made against the Licensee for the off-licence liquor infraction, with penalty submissions to follow.

Following a finding that the licensee violated subsection 45(2) of the Liquor Licence Act by failing to provide inspectors with immediate access to the premises, the Board considered written submissions on sanction.

The Board found that on the first occasion, an uninvited busker played acoustic guitar and was promptly asked to leave by staff, meaning the Licensee did not permit the noise.

On the second occasion, evidence established that the patio was closed, the outdoor speakers were broken, and the weather was extremely cold, making it unlikely the noise emanated from the premises.

The Board dismissed the allegations and set aside the $2,400 monetary penalty.

The Board previously found that the licensee violated subsection 45(1) of Ontario Regulation 719/90 by permitting disorderly conduct and ordered a five-day suspension of its liquor licence.

The licensee proposed suspension dates which were acceptable to the Board.

The Board ordered the five-day suspension to commence on December 14, 2009.

The Registrant, a gaming assistant and dual-rate security supervisor at Kawartha Downs, appealed an Order of Immediate Suspension issued by the Registrar of the Alcohol and Gaming Commission of Ontario.

The suspension was issued after the Registrant was charged with domestic assault against a subordinate co-worker following an off-duty company social event, and failed to report the charge to the AGCO as required by his terms of registration.

The Board found that the Registrant's aggressive behaviour, alcohol-related issues, and failure to report the charge raised serious concerns regarding his integrity and responsibility.

The Board upheld the suspension, concluding it was necessary to protect the public interest and maintain the integrity of the gaming industry.
