The Board noted that recent amendments to the Labour Relations Act, 1995 eliminated any material difference between the consequences of a withdrawal and a dismissal after a vote, as both trigger a one-year bar on subsequent applications.
Finding no substantive reason to dismiss rather than permit withdrawal, the Board granted the applicant leave to withdraw the application.
