On appeal, the Inquiry Officer upheld the application of the Cabinet records exemption to three records, finding they contained policy options or would reveal the substance of Cabinet deliberations.
However, the Inquiry Officer ordered the disclosure of the fourth record, finding it contained background factual information and implementation guidelines rather than advice or recommendations within the deliberative process.
