Factual Background
[1] The late Michele Guz (“Michele”) and Sandra Olszowka (“Sandra”) were sisters. They were daughters of Helen Olszowka (“Helen”) who died on February 28, 2010. Michele died on October 23, 2017. The use of the first names of the various parties is for clarity and convenience and no disrespect is intended.
[2] Prior to February 9, 2010 Helen had sole ownership of the two properties in the City of Brantford described in the Statement of Claim, referred to as the “Patterson Property” and the “Lyndhurst Property” respectively. The Patterson Property was Helen’s residence until her death. The Lyndhurst Property was a five-unit rental property.
