CASE CONFERENCE ENDORSEMENT

[1] A telephone case conference proceeded this morning with a view to keeping the Court updated as to the scheduling of documentary and oral discoveries.
[2] To begin, all parties have agreed to exchange sworn Affidavits of Documents and Schedule “A” productions by September 30, 2019. A potential issue arose dealing with whether Schedule “B” documents in the Shapiro Defendants’ Affidavit of Documents need to be itemized or not. Ms. Secord will be providing her clients’ position, and in the event no agreement can be reached, the parties may participate in another telephone case conference with me to rule upon that issue.
[3] The parties have also agreed that examinations for discovery will proceed on November 18-21, 2019 inclusive (and in any event on or before December 31, 2019), with 12 hours being reserved for the examination of all Defendants, and 12 hours being reserved for the examination of the Plaintiff. It is anticipated that the parties will also agree to have the transcript from the prior cross-examination of the Plaintiffs’ representative stand as discovery evidence for trial purposes.
[4] Finally, Messrs. Atkinson and Grieve are currently searching for new legal representation. As discussed in the telephone case conference, any new counsel should be made aware forthwith of the terms of this Endorsement and in particular the above dates agreed upon by the parties.
