AMENDED REASONS FOR DECISION

[1] These reasons serve to amend my decision dated January 17, 2019, There are three issues to be addressed as per emails sent by Ms. Koon and Mr. Lucas. First, Ms. Koon has reminded me that I had allowed her to provide written submissions on costs after I released my decision on the merits of the motion. As such, I suspend my decision on costs and invite Ms. Koon to make written submissions of no longer than 3 pages double-spaced not including her costs outline within 14 days of today’s date. Mr. Lung may deliver responding submissions of no more than two pages double spaced within 7 days of being served with Ms. Koon’s submissions. Ms. Koon may then deliver a 1-page Reply if needed within 4 days of receiving any response from Mr. Lung.

[2] With respect to direction as to settling the order, Mr. Lung can provide me with his draft order, served on Ms. Koon, for my review and signature. All submissions can be made via email to Ms. Meditskos at Christine.Meditskos@ontario.ca.

[3] Finally, Ms. Koon has inquired whether or not there has been an omission or slip made in my order with respect to paragraph (m) of the August 23 Notice of Motion. There is no slip or omission. She is entitled to seek costs of the Application against Madhany for the reasons explained. She is not permitted to seek costs against him for the within motion.
