Addendum to Reasons
HOCKIN J.
[1] Written reasons were delivered July 8, 2019. Counsel re-attend to ask that the reasons be corrected. The arithmetic, the sum of the overpayment of rent and utilities set out at para. 35 is incorrect. The figures for both are correctly set out at paras. 33 and 34 but the sum is wrong. Counsel for the respondent agrees. Counsel for the applicant and the respondent agree that the figure for the sum of both is $63,142.18. The sum set out in para. 35 will be $63,142.18.
[2] With respect to para. 7(b) of the Notice of Motion, it is agreed that the applicants should be paid the overpayment for June, 2019 rent or $4,613.10.
[3] For the information and documentation with respect to realty or municipal tax and operating costs, the parties have agreed that this will be provided to the applicants not later than thirty days after the respondent has it from the City.
[4] With respect to the claim for the return of the deposit, that was dealt with at para. 37 of my reasons. What will become of the deposit will be decided under the lease. See para. 5.6. All I have decided is that it will not be returned at this point.
[5] The title of proceedings should show the parties as applicant and respondent as pointed out.
[6] The word “arts” will not be removed. Art or arts includes this dictionary meaning: any craft, trade or profession.
[7] The parties will consult with the trial coordinator for a date to decide the costs issue.
