COSTS ENDORSEMENT

[1] Ms. Shah was successful on Mr. Shah’s motion heard March 16, 2018 and is presumptively entitled to costs.

[2] Ms. Shah seeks costs of $3,555 on a partial indemnity basis and $4,425 on a substantial indemnity basis, both inclusive of disbursements and H.S.T.

[3] Mr. Shah suggested mediation in his May 17, 2017 email. Ms. Shah acted unreasonably by failing to respond given that she had consented to the court order that required the parties to mediate.

[4] If Ms. Shah had responded positively, this motion would have been avoided. As such, I award Ms. Shah $1,000 in costs, inclusive of H.S.T., payable within 30 days.
