[1] The plaintiff’s written request dated May 24, 2019 to the Regional Senior Judge - Toronto Region requesting the appointment of a case management judge has been forwarded to me in my capacity as Civil Team Lead - Toronto Region.
[2] The defendant Kenora-Rainy River Districts Child and Family Services (“Kenora-Rainy River”) has brought an in-writing motion returnable before the Regional Senior Judge of the North West Region or his or her designate to have this action transferred from the Toronto Region to the Northwest Region (Kenora).
[3] As a result, it is premature to make the determination of whether or not this action should be assigned to case management and a Toronto case management judge appointed. The plaintiff may renew her request if the transfer motion is dismissed.
[4] The defendant Kenora-Rainy River and the defendant Betty Jenks oppose the request for case management. The Third Parties Nairn Family Homes Inc. and Her Majesty the Queen in Right of Ontario consent to the requested order for case management.
[5] In accordance with the Consolidated Practice Direction for Civil Actions, Applications, Motions and Procedural Matters in the Toronto Region, opposed requests for assignment to case management are to be brought by way of motion. If required, I direct that such motion for case management be in writing, returnable before me in my capacity as the Regional Senior Judge’s designate, subject to any other order.
[6] In the interim, further to the Reasons for Decision and Endorsement of Kimmel J. dated January 9, 2019 and May, 1, 2019 respectively, I direct that any request to vary the order of Kimmel J. is to be directed to and determined by her. Kimmel J. will determine whether such relief is to be sought by way of motion or case conference and will direct the procedure to be followed regarding same.
