[1] Ms Atas has written directly to the court again.
[2] In her email she writes:
The appeal of Justice Corbett's s. 140 Judgment has been argued on April 12, 2019 and the decision is reserved.
I ask that Justice Corbett respect the legal process and halt implementation of his own s. 140 Judgment until the release of the decision from the Court of Appeal.
This is not a frivolous appeal.
I have asked inter alia for an interpretation and application of s.140 of the CJA and Rule 77.
The Court of Appeal's decision will impact the court's interpretation and application of the Statutes and Rules.
I will also add that Justice Rensburg recused herself from the panel on April 12, 2019 as she had also made similar ex-parte "chavali" orders sitting as a Superior Court Judge (as many other Judges have) and this would obviously have tainted the appeal of Justice Corbett's Judgment.
[3] This communication is wholly improper. It asks the court to stay its process, with no motion for a stay, no notice to the other side, no evidence, and despite the prior refusals of both this court and the Court of Appeal to grant prior stay requests from Ms Atas.
[4] Ms Atas has been warned repeatedly not to communicate with the court except as stipulated in the s.140 judgment. In 2018, she was asked to show cause why she should not be cited for contempt for failing to follow these directions. She acknowledged her wrongdoing, apologized, and promised that she would not repeat this conduct.
[5] At the next case management conference the court shall set a date for Ms Atas to show cause why she should not be cited for contempt of court for her improper communication to the court.
