Case Management Endorsement
[1] The parties have not been able to agree on whether two orders ought to be issued, one because the order has allegedly been spent by the effluxion of time and the other because it is addressed, to the extent that it needs to be, in the final order in the s.140 application.
[2] I directed that these matters be addressed at the next case management conference, to be scheduled by me upon release of outstanding endorsements, likely in April.
[3] Ms Atas then wrote to say that the matter cannot wait until April because the requested orders are needed for the appeal of the s.140 decision, scheduled to be heard by the Court of Appeal on April 12, 2019. She did not explain why she did not raise this issues before now, if the orders are needed for her appeal.
[4] Nonetheless, in light of Ms Atas’ statement that she needs the orders issued for her appeal I then directed a special urgent case conference, for one hour, to deal only with the disputed orders.
[5] Now Ms Atas has written to tell me that a conference is not required and that she is not available on March 26th, the date I have specified for the conference.
[6] I have decided this shall be dealt with at a conference. It is not proper for Ms Atas to write to me expressing her disagreement with that decision.
[7] As for the date selected, Ms Atas has said she “is not available” but once again, notwithstanding this court’s several admonishments on this topic, she has not explained why March 26th is not convenient for her.
[8] The conference will proceed, as scheduled, on March 26th.
