REASONS FOR DECISION - COSTS
[1] The Plaintiff, Kelly Cormier, sued her former employer 1772887 Ontario Limited, which carries on business as St. Joseph Communications. Ms. Cormier was dismissed without cause, and she claimed $136,577.75 in damages. I granted Ms. Cormier a judgment for $112,863.75, plus prejudgment and postjudgment interest.[^1]
[2] Ms. Cormier claims costs of $32,509.05, all inclusive. This sum was calculated on a partial indemnity basis for fees incurred to January 2, 2019, and relying on an unaccepted offer to settle, it was calculated on a substantial indemnity basis for the time after January 2, 2019 thereafter.
[3] St. Joseph Communications, whose costs outline claims $33,042.09, submits that Ms. Cormier’s claim for costs is excessive for a variety of reasons largely associated with alleged double lawyering and allegedly redone or overdone legal service. St. Joseph Communications submits that the appropriate award should be $15,451.50,
[4] I disagree and I am not persuaded that Ms. Cormier’s claim for costs should be reduced at all. In my opinion, the costs claim was fair and reasonable and it was certainly within the reasonable expectations of St. Joseph Communications.
[5] I, therefore, award costs as claimed.
