[1]. I have and thank counsel for their written argument with respect to the issue costs.

[2]. For largely the same reasons expressed at paragraphs 11 and 14 of the original endorsement, I remain unconvinced that this is a situation where costs should be awarded.

[3]. While the plaintiff was successful in obtaining the amendment to the pleadings the timing of the motion should preclude any costs award.

[4]. Therefore, there will be no order as to costs.
