ENDORSEMENT

At the request of the Civil Team Leader- Motions, I have reviewed the material filed in respect of the two cross-motions that are currently scheduled to be heard on December 15, 2015. I require a Case Conference pursuant to Rule 50.13(1) of the Rules of Civil Procedure. Mr. Sun and Mr. Khan shall both attend the Case Conference in person during the week of November 30, 2015 and at a time and place to be set by the Civil Motions Coordinator.
The Case Conference will deal with the following matters:

(a) Identifying the issues for resolution on December 15, 2015;

(b) Exploring methods to resolve the issues; and

Mr. Sun and Mr. Khan are also notified that under Rule 50.13(6), at the Case Conference the Court may order that pending the hearing of the two existing motions, one or both of them deliver further evidence, undergo oral examination, or comply with outstanding order(s).
