ENDORSEMENT
[1] The trustee Helen Shewchuk has prepared accounts for the period January 1, 2008, to March 13, 2010, while she acted under a Power of Attorney for her mother. Two of her siblings object in part to the accounts. From the volume of material it is obvious to me that further work is required on this file before it will be ready for a judge to deal with it. Therefore I am directing the parties as follows:
The objectors shall prepare a document that sets out only those particular expenditures they contest with reasons. The same document shall set out the trustee’s explanation for the expenditure. As well, if the accountant has dealt with the expenditure this too shall be included. Each item shall be dealt with in this fashion much like in the form of a chart.
This document once completed shall be served upon the trustee for her further comment if any. I anticipate this process to take no longer than 60 days from this date.
Once this above process is complete, the parties shall seek a judicial resolution date from the trial coordinator. One day ought to be set aside.
Thereafter, if the matter is not resolved, the resolution hearing judge ought to give further directions for the hearing.
