ENDORSEMENT
[1] The pretrial of this action continued today, however no resolution was achieved.
[2] As counsel advised that the jury trial of this action will take 6 to 8 weeks, this case will not proceed at the May 2016 blitz sittings. The case will be vacated from that trial list.
[3] As counsel were advised, I will fix a trial date, given the length of the trial, which may be conducted in Kitchener. I will seek the cooperation of Regional Senior Justice Turnbull of Central South Region in setting a trial date in Kitchener. Counsel will be advised of that date.
[4] Counsel advised that in addition to the trial time as noted, there will be five days of pretrial motions to be conducted before the jury selection.
[5] I will remain the case management judge in this matter and any scheduling issues should be brought to my attention immediately.
[6] As to trial management – parties are to prepare and file a joint document book to facilitate the introduction of documentary evidence, the authenticity of which and truth of the contents are not in dispute. Additionally, if necessary, if there are documents to be introduced in evidence, which all parties agree as to the authenticity – but not the truth of the contents of same – a separate book of joint documents is to be prepared and filed with the court.
[7] Counsel shall submit to the court at least 10 days in advance of the commencement of the pretrial motions the agreed-upon questions for submission to the jury, or alternately, if the questions are not agreed to, counsel shall each submit their proposed questions for consideration by the court.
