[1] The Applicant was successful in this application for judicial review by way of Habeus Corpus and Certiorari in relation to his re-classification from minimum to medium security at Beaver Creek Institution. However, he is not seeking costs in light of that outcome. Accordingly, there will be no costs awarded herein. I am purposefully making no comments as to the merits of the Applicant’s position that, generally, a prisoner should never face costs’ consequences for a failed application for judicial review of this nature.
