[1] The applicant was overwhelmingly the successful party in this case. She obtained a divorce, sole custody of Halima, a non-removal order, an order permitting her to travel with the child and to obtain travel documents without the respondent husband’s consent, a restraining order and an access order that accommodated the child’s needs. She did not obtain an order for spousal support nor the quantum of child support that she was seeking nor retroactive child support. While I understand her desire for a Talaq, she sought this relief when she knew or should have known that this court had no jurisdiction to order such relief from the respondent.
[2] On the other hand, all of the relief sought by the respondent in his answer was dismissed by this court.
[3] As such this court orders that the respondent pay to the applicant her costs fixed at $80,000 inclusive of fees and disbursements, $30,000 of these fees may be collected by FRO as they relate to costs incurred in pursuit of support.
[4] Additionally, the respondent shall pay to the applicant her share of the Barry Brown fees and HST being $12,351.08 forthwith.
