REASONS FOR DECISION - COSTS
[1] This is a costs decision in two actions that the Defendants were successful in having dismissed. See Raba v. Wronecki, 2015 ONSC 20.
[2] The Defendants seek costs of $2,000, all inclusive, for each action ($4,000), which is a modest and reasonable sum for the successful parties in two actions and more modest still when these costs are set-off against the costs that I awarded the Plaintiff Mr. Raba for two motions earlier in the proceedings.
[3] Mr. Raba was not successful on the motions, but I, nevertheless, awarded him $1,500 ($3,000) for wasted costs.
[4] Mr. Raba’s costs submissions were a re-argument of the recent motions, and he provided no reason to refuse to award the very reasonable amount of costs being sought by the Defendants.
[5] I, therefore, award the Defendants the costs requested.
[6] The Defendants may take out an order without Mr. Raba’s approval as to form and content.
