ENDORSEMENT

[1] Costs are intended to compensate the successful party to the litigation for allowable legal costs incurred. In this action, the plaintiff was substantially successful and is entitled to its costs.

[2] In exercising my discretion to award costs, I have considered the factors set forth at R. 57.01(1) of the Rules of Civil Procedure, the reasonableness of the costs sought by the plaintiff and also have considered proportionality. I award costs payable by the defendants to the plaintiff on a partial indemnity basis in the amount of $44,312.35 all inclusive.
