1Costs are intended to compensate the successful party to the litigation for allowable legal costs incurred. In this action, the plaintiff was substantially successful and is entitled to its costs.

2In exercising my discretion to award costs, I have considered the factors set forth at R. 57.01(1) of the Rules of Civil Procedure, the reasonableness of the costs sought by the plaintiff and also have considered proportionality. I award costs payable by the defendants to the plaintiff on a partial indemnity basis in the amount of $44,312.35 all inclusive.
