COSTS ENDORSEMENT

[1] Costs are intended to compensate the successful party to the litigation for allowable legal costs incurred. The defendants were wholly successful in defending this action and are entitled to their costs.

[2] In exercising my discretion to award costs, I have considered the factors set forth at R.57.01(1) of the Rules of Civil Procedure, the reasonableness of the costs sought by the defendants and also have considered proportionality. I award costs payable forthwith by the plaintiff to the defendants in the amount of $56,000, inclusive of fees, disbursements and HST.
