Although this matter was decided on January 22, 2015, for unknown reasons the cost submissions have only been presented to me on June 8, 2015.

[1] I accept entirely the submissions presented on behalf of the Applicant and Respondent, Donald Vitek.

[2] Considering the history and the outcome of the proceedings, and applying the criteria of the Rules respecting costs assessments, costs are awarded against the Respondent, Randall Vitek as follows:

a. To the Applicant, $8,932.65 inclusive of fees, disbursements and HST;

b. To the Respondent, Donald Vitek $16,450.48 inclusive of fees, disbursements and HST.
