Roelandt v. Roelandt 2015 ONSC 3228
COURT FILE NO.: 64-2014
DATE: 2015/05/20
SUPERIOR COURT OF JUSTICE - ONTARIO
RE: Kenneth Roelandt, Applicant
AND:
Yvonne Roelandt, Martina Roelandt, Nelly Burwell, and The Public Guardian and Trustee, Respondents
BEFORE: Justice P.B. Hockin
COUNSEL: Ian McLean, Counsel, for the Applicant
Mary Cull, Philip Cornish & James McIlhargey, Counsel, for the Respondents
HEARD: April 29, 2015
ENDORSEMENT
It is unfortunate that there has been a great passage of time since the commencement of this application. And there has been effort of Kenneth Roelandt and Mr. McLean to moving the matter forward that this. However, an adjournment is unavoidable. Ms. Cull has only recently been retained by Martina Roelandt – the Legal Aid Certificate after an appeal following a refusal was delivered only a week or so ago – April 20, 2015. A hearing at this point without some time for Ms. Cull to investigate and define a position for Martina would be a step backward and expose the parties to an appeal which I would have thought would be granted without much debate. As well, Mr. McIlhargey and Mr. Cornish are new to the file.
An adjournment is therefore granted. Therefore, adjourned to June 24, 2015 TBST. Mr. McLean may appear by teleconference or video.
