COSTS RULING
Introduction
[1] As is obvious by my ruling of November 13, 2014, the Defendants were completely successful on this summary judgment motion.
[2] They now seek costs in the total amount of $13,897.75 on a partial indemnity basis. An Offer to Settle was delivered by the Defendants, which offered the Plaintiff the ability to walk away without paying rent for February or March of 2014 and without paying the bailiff’s charges. That same Offer, if accepted, would see a Plaintiff not paying any costs to the Defendants.
[3] The matter was not complex, but was of high importance to the parties. The Plaintiff delivered a Costs Outline of one-half a page which made no comment whatsoever on the Defendants’ costs submissions or Costs Outline.
[4] Instead, the Plaintiff sought costs of $9,000, without detail or any embellishment, except for the number of hours and the hourly rate.
[5] The Plaintiff’s submissions help to satisfy me of the fairness and reasonableness of the Defendants’ claim for costs. Accordingly, the Defendants shall have their costs, as sought, in the amount of $13,897.75.
