ENDORSEMENT
[1] The defendant moved successfully for summary judgement on Statutory Accident Benefits action: 2015 ONSC 1485. It now seeks costs. The plaintiff submits that he should pay $2,500. The defendant asks for just over $10,000.
[2] The plaintiff was not seriously injured in the car accident. He waited years and years to make a claim for accident benefits. Then he accused the defendant of dishonesty without any reason to do so. The defendant should have substantial indemnity. Their bill of costs is modest in any event.
[3] I fix costs at $10,000 all-inclusive and order the plaintiff to pay this amount to the defendant.
