COSTS ENDORSEMENT
[1] The defendants seek their costs on a partial indemnity basis in the amount of $10,298.20. They were wholly successful as regards the motion to dismiss and the plaintiff's request for an anti-suit injunction preventing the foreign proceedings in St. Kitts from continuing.
[2] In awarding costs, I have taken into consideration the general principles for awarding costs and the factors to be considered in exercising this Court's discretion as set forth at Rule 57.01(1) of the Rules of Civil Procedure. I have further taken into consideration the fact that the plaintiff, Kareem Glasford, represented himself and his mother, Bronwyn Glasford, in these motions. However, I do not find the fact that the plaintiffs were self-represented to be a reason for denying costs to the successful defendants. In this regard, I have taken into account the cases of Suserski v Nurse, [2007] O.J. No. 965 and St. Lewis v Rancourt, 2013 ONSC 6118.
[3] I am satisfied, in all of the circumstances, that the defendants’ partial indemnity costs are reasonable and should be awarded. I award costs in favour of the defendants, to be paid by the plaintiffs forthwith in the amount of $10,298.20.
