[1] The motion for leave to appeal the decision of Ontario Land Tribunal dated January 19, 2022 and the review decision of the Ontario Land Tribunal dated March 27, 2023, is granted, with costs of $25,000, inclusive, payable in the discretion of the appeal panel. This leave motion was delayed through administrative error and the underlying appeal is to be expedited as a result. The parties shall provide their agreed schedule for exchange of appeal materials to the court, by email, by October 31, 2025, failing which they shall schedule a case management conference to be held by the end of November 2025. If a suitable expedited hearing date cannot be found on a docket in Ottawa, then the appeal shall be heard by a Toronto panel, by ZOOM, on a suitably early date.
