[1] In our view the impugned order is solely in respect to costs, and thus leave to appeal is required pursuant to the Courts of Justice Act. The motion for leave to appeal the costs orders of Harper J., dated March 31, 2022 and January 6, 2021 (2021 ONSC 103) are granted in respect to the denial of costs to the Estate Trustee During Litigation payable by any of the parties or from the Estate. Costs of this leave motion are fixed at $2,500, payable in the discretion of the appeal panel.
