The applicant filed an application alleging discrimination on the ground of disability in the termination of his employment.
Following a mediation, the applicant and two respondents requested that the application be deferred pending the outcome of a successor employer determination before the Ontario Labour Relations Board (OLRB).
The Tribunal found significant overlap between the application and the OLRB matter regarding the potential liability of some respondents.
To avoid concurrent proceedings and the possibility of inconsistent decisions, the Tribunal deferred the application pending the conclusion of the OLRB proceedings.
