DECISION ON MOTION FOR LEAVE TO APPEAL
[1] The motion for leave to appeal the decision of the Ontario Land Tribunal dated September 13, 2021 (2021 88675 (ON LT)), is dismissed, with costs fixed at $15,000, inclusive, payable to Lifetime Developments and with no costs payable to or by City of Toronto or Ontario Land Tribunal. The costs are payable to Lenczner Slaght LLP, in trust, at the rate of $500.00 per month, commencing June 1, 2022. If the moving party misses any costs payment, the entire balance owing shall immediately be due and payable.
[2] As I explained to Mr Shieff during the hearing, this court does not give reasons for decisions on motions for leave to appeal: Westhaver Boutique Residences Inc. v. Toronto, 2020 ONSC 3949 (D.L. Corbett J.); Action Champlain c. Colacem Canada Inc., 2021 ONCS 4690 (Boucher J.); Craft Acquisitions Corp. v. P.I.T.S. Development Inc., 2020 ONSC 7174 (Favreau J. (as she then was)). There is no reason to depart from this practice in this case.
