[1] The motions for leave to appeal from the decision of Cavanagh J. dated August 26, 2021 (2021 ONSC 5758) are all granted (Div. Ct. Files 749/21, 750/21, 758/21, 764/21, 765/21, 768/21 and 769/21), with costs in the agreed amount of $20,000, inclusive, payable by the responding parties, jointly and severally, to the moving parties, jointly and severally, as agreed among the parties, payable within thirty days.
[2] Counsel shall attend a case management teleconference with D.L. Corbett J. on October 28, 2021 at 1:00 pm, to settle a schedule for exchange of appeal materials and to schedule an expedited appeal date that respects the schedule for the upcoming trial. Counsel are asked to try to confer on these topics prior to the case management teleconference. Counsel should also be prepared to discuss issues around sealing orders at the case management teleconference.
