[1] The appellant submits that he should not have to pay the respondent’s costs of the appeal because, in his view, the court made a number of errors in dismissing the appeal, and it still has jurisdiction to correct them. Even if this were a valid ground for a refusal to award costs (which it is not), the argument would not be open to the appellant, given that his application for leave to appeal the decision of this court to the Court of Appeal was dismissed with costs.
[2] Having considered the submissions of both parties, we fix the respondent’s costs at $15,000, payable within thirty days of today’s date.
