[1] The Parties have delivered costs submissions in relation to the court’s decision to dismiss this proceeding dated November 27, 2019 reported at 2019 ONSC 6868.
[2] In light of the respondent’s success on the merits, it is entitled to costs on a partial indemnity basis. The hours and billable rates claimed in the respondent’s Costs Outline are reasonable. Therefore, the applicant shall pay the respondent its costs of this application fixed in the amount of $7,788.37 all-inclusive within thirty (30) days.
