[1] Both parties agree that the plaintiff's notice of motion including its request that the order of the Registrar dismissing the appeal be set aside are properly before the court.
[2] The respondent here served its responding record on the evening of October 10th. The appellant seeks an adjournment of 30 days so that he may properly consider and answer it. Given the fact that the order under appeal, if upheld, will put an end to this very lengthy and convoluted law suit. I think the request by the respondent is not unreasonable except as to the length of delay requested.
[3] Accordingly, this motion is adjourned to a date to be fixed by the Registrar, which date shall be after October 29th. No further proceedings other than relating to this motion shall be initiated by either party until this matter is disposed of.
[4] Costs of today to be dealt with by the judge finally disposing of this motion.
