Upon resuming:
THE COURT: All right, so in the matter of Danielle Davidson, it's an application for a peace bond that's been brought under S.810 of the Criminal Code. The Crown is intervening on the matter and brings an application under S.486.3 to have counsel appointed to cross-examine, on behalf of the defendant, the complainant.
The statutory authority is by way of S.810(5) of the Criminal Code, S.810 governing the procedure for the peace bond hearing, and S.810(5) saying that the provisions of the summary conviction part of the Code apply with modifications as necessary to proceedings under S.810.
I am therefore persuaded, as a result, that the Criminal Code provisions and procedures apply to proceedings under S.810, and therefore the procedure under S.486.3 applies, and therefore there is jurisdiction to make the order.
