Reasons for Decision

[1] The appellant Hui Shang appeals from the Order of Kaufman J. of the Superior Court of Justice, Family Court dated March 19, 2024. The Order flowed from a settlement conference and resolved various legal issues in accordance with Minutes of Settlement signed by the parties.

[2] The appellant has brought his appeal in the wrong court. Section 19(1) of the Courts of Justice Act, R.S.O. 1990, c. C.43 provides:

An appeal lies to the Divisional Court from…

(a.1) a final order of a judge of the Family Court made only under a provision of an Act or regulation of Ontario.

[3] Justice Kaufman’s Order was made pursuant to the provincial Family Law Act, R.S.O. 1990, c. F.3. Accordingly, any appeal of that Order must be taken to the Divisional Court.

[4] The appeal is quashed.
