APPEAL BOOK ENDORSEMENT
[1] We see no error in the reasons of the motion judge. The charging orders over any settlement funds were properly issued. The respondent acknowledges that any claim that the solicitor get off the record without just cause can be taken into account by the assessment officer in determining what fees are reasonable. The appeal is dismissed.
[2] We would also dismiss the cross-appeal. The motion judge acted within his discretion in awarding no costs and we would not interfere.
[3] To preserve solicitor client confidences, the court’s file is to be sealed.
[4] Costs of today payable to the respondent fixed at $3000 inclusive of disbursements and GST.
