DATE: 20100318
DOCKET: C50805
BEFORE: Blair, LaForme JJ.A. and Durno J. (Ad Hoc)
BETWEEN
Her Majesty the Queen
Respondent
and
Christina Marie Hammond
Applicant/Appellant
COUNSEL:
L. Strezos duty counsel
Holly Loubert, for the respondent
HEARD: March 17, 2010
On appeal from the judgment of Justice G. Mark Hornblower of the Ontario Court of Justice dated April 27, 2009.
APPEAL BOOK ENDORSEMENT
[1] To set aside the conditional sentence imposed by the trial judge, we would have to conclude that he erred in principle or that the sentence was demonstrably unfit. Given the circumstances of the offence and the offender, we are not able to conclude that either is the case.
[2] Accordingly, while leave to appeal sentence is granted the appeal as to sentence is dismissed.
[3] Ms. Hammond has abandoned her appeal as to conviction. It is therefore dismissed as abandoned.
