[1] The appellant appeals from the judgment of Mesbur J. dated July 30, 2009 dismissing his action against the respondents Dr. John Wedge and the Hospital for Sick Children.
[2] We see no error in the motion judge’s analysis on the many issues raised by the appellant. It follows that her conclusion that the appellant had not adduced any evidence capable of raising a genuine issue for trial is correct. We also agree with the motion judge’s conclusion that the appellant’s action is frivolous and vexatious and an abuse of the court’s process.
[3] The appeal is dismissed. The respondents are entitled to their costs of the appeal fixed at $3000 each, inclusive of disbursements and GST.
