APPEAL BOOK ENDORSEMENT
[1] We would dismiss the appeal. We see no error in the decision of Stewart J. In respect of the arguments raised by the appellant, we state as follows:
(1) The statute prevails over the Rules of Court. The rules in the statute were followed – notice was not required.
(2) Consequently, we see no breach of natural justice or procedural fairness.
(3) The judges below had jurisdiction to make the orders that they did.
[2] Costs to the respondent fixed at $2500, all inclusive.
