CITATION: R. v. Okkema, 2009 ONCA 284
DATE: 20090408
DOCKET: C49545
COURT OF APPEAL FOR ONTARIO
BEFORE: Goudge, Cronk and LaForme JJ.A.
BETWEEN:
Her Majesty the Queen Respondent
and
Henry Okkema Appellant
COUNSEL: Henry Okkema, acting in person Anita Szigeti Amicus Curiae G. Choi, for the Crown Diane Chick, for Regional Mental Health Care, St. Thomas
HEARD: March 27, 2009
On appeal from the Ontario Review Board dated September 30, 2008.
APPEAL BOOK ENDORSEMENT
[1] In our view the Board was clearly aware of the appellant’s request for a conditional discharge, and having rejected the hospital’s more restrictive proposal necessarily rejected a conditional discharge.
[2] The Board determined that in the appellant’s present circumstances, despite the progress he had made, it was premature to reduce the restrictions on him except for a pass for an additional week. There was an ample evidentiary basis for the Board doing so. The Board’s decision was not unreasonable.
[3] The appeal must be dismissed.
