DATE: 20071003
DOCKET: C46990
COURT OF APPEAL FOR ONTARIO
WEILER, MOLDAVER and ROULEAU JJ.A.
BETWEEN:
HER MAJESTY THE QUEEN Respondent
and
TIMOTHY WELDON Appellant
Counsel: Timothy Weldon in Person Dan Brodsky Amicus Curiae Jean Buie for the Centre for Addiction and Mental Health Amanda Rubaszek for the respondent Crown
Heard and endorsed: October 1, 2007
On appeal from the disposition of the Ontario Review Board dated October 13, 2006.
APPEAL BOOK ENDORSEMENT
[1] The appellant submits that the Board misunderstood the terms of the joint recommendation as regards his community and grounds supervision. The record does not support the appellant’s contention. On the contrary, it shows that the Board specifically referred to the terms of the agreement, as the members understood them to be, and in the presence of the appellant, amicus stated that he understood the changes.
[2] In any event, the Board gave careful reasons for adding restrictions to the appellant’s community and grounds privileges. We see no basis for interfering. We note as well that the appellant is scheduled to have a fresh review hearing on October 5, 2007, at which time we are certain that the Board will review, among other things, the conditions that the appellant takes issue with.
[3] Accordingly, the appeal is dismissed.
