BETWEEN:
HER MAJESTY THE QUEEN

and
KELLY ASHTON

John L. Hill, for the appellant

On appeal from the conviction entered by Justice B.G. Macdougall of the Superior Court of Justice on February 21, 2006.
APPEAL BOOK ENDORSEMENT
[1] Despite Mr. Hill’s able argument, we are not persuaded that the trial judge made any errors in his findings of fact, including his assessment of the credibility of both the complainant and Ms. Frank. Accordingly, we see no basis to interfere with the conviction.
[2] The appeal is dismissed.
