On appeal from the conviction entered on May 18, 2005 by Justice McRae of the Superior Court of Justice, made at Toronto, Ontario.
A P P E A L B O O K E N D O R S E M E N T
[1] The finding by the trial judge, that the accused intended to mislead by having the court at his bail hearing accept as credible, evidence that he knew was dishonest to advance his position, is supported by the evidence.
[2] It need not have been evidence on a material point. See R. v. Prashad 2004 ONCA 34382, 73 O.R. (3d) 307.
[3] The appeal is dismissed.
